    General Terms and Conditions

    1. Scope

The following General Terms and Conditions shall apply for all orders placed via our Online Shop.

    2. Contractual partners, conclusion of contracts

The contracts of sale are created in collaboration with Juice Technology AG.

The presentation of products in our Online Shop does not constitute a legally binding offer, but rather a non-binding online catalogue. You can initially place our products in your shopping cart on a non-binding basis and subsequently correct your entries at any time prior to submitting your binding order by utilising the correction aids provided and explained for this purpose over the course of the purchasing workflow. By clicking the order button, you submit a binding order for the items contained in your shopping cart. The confirmation of receipt of your order will be sent to you by e-mail immediately after submitting the order.

The contract of sale first becomes effective when you receive from us a separate order confirmation or invoice drawn up by hand. The contract of sale may be transmitted by e-mail.

The following modes of payment are available to you, the selection of which has no bearing on the creation of the contract of sale:

    Credit card
When you submit your order, at the same time you provide us with your credit card details. After your authorisation as the rightful holder of the credit card, we request your credit card company to initiate the payment transaction.

    PayPal
In the ordering process, you are forwarded to the website of the online provider PayPal. There, you can indicate your payment data and confirm the payment order to PayPal. Once you have submitted your order at the Online Shop, we request PayPal to initiate the payment transaction.

    Advance payment
You can pay directly by bank transfer on the basis of the confirmation of order receipt or after receipt of our manually prepared invoice. The bank details for this purpose are always indicated in each case, and accounts are available within the EU and in Switzerland.

    3. Contract language, storage of the contract text

The languages available for concluding the contract of sale are German and English.

We store the contract text and send you the order data and our General Terms and Conditions by e-mail. You can also always find the General Terms and Conditions here on this page of our website. For reasons of data security, your past orders are no longer accessible via the Internet.

    4. Terms and conditions of delivery

Shipping costs are added to the indicated product prices. Details on the amount of these shipping costs can be found in the individual offers.

We deliver exclusively by parcel shipment. It is unfortunately not possible to personally collect items from us.

We do not deliver to Packstations, i.e. automated booths for self-service collection of parcels.

    5. Mode of payment

As a general rule, the following modes of payment are available to you at our Online Shop:

    PayPal
In the ordering process, you are forwarded to the website of the online provider PayPal. In order to be able to pay the invoiced amount via PayPal, you must either already be registered with PayPal or register with them as a new user, obtain authentication with your access data, and confirm the payment order to us. Once you have submitted your order at the Online Shop, we request PayPal to initiate the payment transaction. You will receive further information and instructions in the ordering process. PayPal will then automatically implement the payment transaction immediately afterwards.

    Credit card

When you submit your order, at the same time you provide us with your credit card details.

After your authorisation as the rightful holder of the card, we request your credit card company to initiate the payment transaction immediately after you submit your order. The credit card company automatically implements the payment transaction, and the amount is debited to your card.

    Advance payment
You can pay directly by bank transfer on the basis of the confirmation of order receipt or after receipt of our manually prepared invoice. The bank details for this purpose are always indicated in each case, and accounts are available within the EU and in Switzerland.

    6. Retention of title

We retain ownership of the goods until full payment has been rendered.

    7. Transport damage

If goods arrive at their destination displaying clearly evident damage from transport, please submit a claim for said damage to the carrier immediately or as soon as you can, and notify us thereof without delay. While failure to submit a claim to the carrier or to contact us has no consequences with respect to your legal claims and enforcement thereof, in particular your rights under the warranty, such reporting helps us to assert our own claims against the freight carrier and/or the transport insurance.

    8. Statutory guarantee and warranties

Unless expressly agreed otherwise below, the statutory laws governing the liability for defects shall apply.

The warranty limitation period for claims for defects in used goods is one year after delivery of the goods.

The above restrictions and period limitation do not apply for claims arising from damage caused by us, our legal representatives or vicarious agents

    • in case of injury to life, limb or health,
    • in case of intentional or grossly negligent dereliction of duty or fraud,
    • in case of breach of significant contractual obligations, the fulfilment of which are what make orderly performance of the contract possible in the first place, and the contractual partners can be regularly relied on to comply with (cardinal duties),

within the scope of a promise of guarantee, insofar as agreed, or
    • to the extent covered by the scope of applicability of Germany’s Product Liability Act.

You will find information on any potentially applicable additional warranties and their exact terms and conditions noted with the product and on special information pages at the Online Shop.

Customer Service: For any queries, claims or complaints, you can reach our Customer Service weekdays from 9:00 a.m. to 12:00 noon and 2:00 to 5:00 p.m. by telephone at +41 (0)41 510 02 19 as well as by e-mail at service@juice-technology.com.

    9. Liability

We always accept liability with no limitation for any claims based on damage caused by us, our legal representatives or vicarious agents

    • in case of injury to life, limb or health,
    • in case of intentional or grossly negligent dereliction of duty,
    • In case of promise of guarantee, insofar as agreed, or
    • to the extent covered by the scope of applicability of Germany’s Product Liability Act.

in case of breach of significant contractual obligations due to slight negligence on the part of us, our legal representatives or vicarious agents, the fulfilment of which are what make orderly performance of the contract possible in the first place, and the contractual partners can be regularly relied on to comply with (cardinal duties), the amount of liability is limited to the foreseeable damage at the time the contract was concluded, the occurrence of which must typically be expected to occur. All other compensation claims for damages are excluded.

    10. Online dispute resolution

Online dispute resolution in accordance with Art. 14 Section 1 of the EU Online Dispute Resolution Regulation: The European Commission makes a platform available for Online Dispute Resolution (ODR) that you can access here: http://ec.europa.eu/consumers/odr/ .
